Job Description Responsible to the sales teams and senior management on commercial risk of contracts from tender stage through to final completion.
Review of Trane contracts for onerous, unfavorable and unacceptable terms Monitors and controls the costs, commercial activities required for each contract working closely with out sales teams.
Contract review both from suppliers/customers perspective, protecting the company’s position throughout a contract ensuring compliance with the companies’ policies and contractual obligations Advising and reviewing contracts with acquisition & sales teams
Responsibilities
Ensure suppliers and subcontractors are aligned throughout contracts. Challenge internal teams regarding contractual obligations pre and post order Deliver training packages to internal sales teams on contract negotiation and obligations Advise acquisition, sales and senior management of risk regarding commercial aspects of all enquiries, including the balance of contractual risk/estimate and risk/acceptable profit prior to submission of a tender to a client. Establish contract documentation ensuring it complies with company policy Ensure that an original complete set of contract documents, including drawings, is completed as necessary and stored in a secure fireproof place. Formulate, in conjunction with the contract team, a commercial plan specific to each contract identifying the activities necessary to protect the company and enhance the profitability of contracts. Ensure that contract progress is monitored and controlled against defined contract. Identify and investigate any variances from plan and notify appropriate personnel to agreeing and implement appropriate remedial action with contract management. Maintain highest levels of commercial confidentiality at all times
QUALIFICATIONS, SKILLS AND EXPERIENCE Preferably educated to degree level (or equivalent) standard Current driving license Previous commercial / contractual experience Knowledge of contract law Experience of working within building services environment would be beneficial Effective communication, influence and negotiation skills with individuals at all levels Common sense and flexible approach Good understanding of Financial and Commercial risk analysis Understanding of the Building Services industry Business Planning Problem solving and decision making Ability to work well with others Self motivated and able to motivate others Good leadership skills Results orientated Customer focused
